Negotiating and documenting BNG deals

We have recorded a series of six podcasts where we explore common issues encountered by rural businesses and estates. These podcasts aim to share our knowledge and experience in order to provide thought provoking and informative discussions.

Throughout the series, Adam Corbin is joined by lawyers from across Michelmores who work collaboratively on transactions and disputes concerning these issues for our clients. The core themes we will be covering are: modern challenges in rural estate management, environmental opportunities, and future food production challenges and opportunities.

In our final episode we are talking about the fast developing topic of buying and selling environmental obligations. These transactions are commonly taking the form of the sale of Biodiversity Net Gain, or Nutrient Neutrality credits, and as such are commonly encountered in development deals. I am joined by lawyers who have lead the field in these types of transaction, and are able to speak from a position of significant authority on the topic. We will review how the law has developed to the position we are presently in, as well as how it might develop in the future. We then look at common challenges encountered in doing deals at the moment, as well as how these challenges fit, or don’t fit in the current market.
