Negotiating and documenting BNG deals

In our final episode, we are talking about the fast developing topic of buying and selling environmental obligations. These transactions are commonly taking the form of the sale of Biodiversity Net Gain, or Nutrient Neutrality credits, and as such are commonly encountered in development deals. I am joined by lawyers who have lead the field in these types of transaction, and are able to speak from a position of significant authority on the topic. We will review how the law has developed to the position we are presently in, as well as how it might develop in the future. We then look at common challenges encountered in doing deals at the moment, as well as how these challenges fit, or don’t fit in the current market.
