Trade mark dispute is hazy for cider manufacturers

UK brewery, Hogs Back Brewery has issued proceedings against cider brand Magners (owned by the C&C Group) for trade mark infringement.

The dispute between the cider makers relates to a portable cider dispenser, “Cider Hog”, launched by the Magners brand in June 2014.  Hogs Back Brewery considers that the use of this name and similar graphics infringe the “Hazy Hog” trade mark registered by Hogs Back Brewery in 2013.

Magners has a UK trade mark for its “Cider Hog” product, although in a different class.

Hogs Back Brewery and Magners were understood to be in discussions to attempt to resolve the matter amicably and avoid court proceedings, no doubt with their Civil Procedure Rules (CPR) obligations in mind; however a solution has not so far been possible.

It will be interesting to see how far this case continues and whether a settlement can be reached, although any agreement is likely to be confidential between the parties. We will keep you updated.
