Bernadette is a Partner in the Clinical Negligence team. She specialises in brain injuries, including birth-related neurological damage and maternal injury.

Prior to training as a solicitor, Bernadette qualified as a general and paediatric nurse and enjoyed a very successful clinical career for many years. This background knowledge lends her an advantage when acting for claimants in medical litigation, and forms the basis of her special interest in paediatric and birth injury cases. She is also a member of national charity Baby Lifeline's multi-professional advisory panel (MPAP).

Bernadette was a Trustee of the Meningitis Trust for many years and, building on this and her nursing experience, maintains a firm interest in meningitis. She is also an AvMA Clinical Negligence Panel member.


Recent Experience

  • Bernadette led the investigations to achieve a recent settlement on liability in DS v Royal Devon & Exeter Healthcare NHS Foundation Trust. DS suffered a brain injury during his birth, resulting in cerebral palsy. Bernadette is now continuing to investigate DS' current and future needs, to reach a substantial settlement that will help him throughout his life.
  • In Bernadette's case of Ganz v Dr Child & Dr Lloyd & Kingston Hospital NHS Trust, the claimant had suffered a brain injury after a delay in referral to hospital for treatment for pneumonia. Bernadette took over the case from another firm of solicitors, and succeeded in bringing the claim to a successful trial on liability. The matter settled out of court, with Bernadette's client receiving a multi-million pound settlement; this has allowed her to live a more independent life, despite her catastrophic injury.
  • The case of TP v North Devon Healthcare NHS Trust involved a young man who suffered significant brain damage following a failure to expedite his birth by caesarean section, despite evidence of foetal distress during labour. His substantial damages award ensures that his family will have funds to provide 24-hour care for the rest of his life.
  • Bernadette conducts a busy caseload, including a wide range of high-value birth injury and maternal damage claims.
