Jurors may hear evidence of how documents went missing
A US magistrate has concluded that Ethicon, the arm of pharmaceutical leviathan Johnson & Johnson, lost or destroyed thousands of documents and data files relating to development of its mesh devices. The practice is said to have extended as far back as 2007.
With Johnson & Johnson facing its first mesh trial in the US in February, jurors may be allowed to hear evidence of the company's failure to retain the documents if they can prove that this places their claims at a disadvantage.
