Tony Cockayne - Partner
Team: Commercial Dispute Resolution / Disputed Trusts & Wills
Tony joined Michelmores' Commercial Dispute Resolution Team in 2002 and was made Partner in 2009. Tony advises on a wide range of matters including shareholder disputes, partnership disputes, contractual claims and large debt matters.
Tony is also the Head of the Disputed Wills and Trusts Team. He regularly advises on disputes involving legacies to Charities and the validity of Wills, claims under the Inheritance (Provision for Family and Dependants) Act 1975, problem Executors, claims against solicitors, difficulties arising from a sale of property within an Estate, equitable claims (including proprietary estoppel), undue influence and fraud.
Recent work includes:
- County Homesearch Co (Thames & Chilterns) Ltd v Cowham [2008] 1 W.L.R 909, a case involving considerations with regard to implied contract terms and the application of the doctrine of the effective cause in a home finder situation;
- Acting for the spouse of a famous artist in relation to the provisions of his will;
- Securing a settlement in a case involving a complex estate with aspects relating to Texan law;
- Acting in a claim under the Inheritance (Provisions for Family and Dependants) Act 1975 on behalf of the wife of a prominent local solicitor;
- Acting on behalf of the Defendants in a High Court Trial regarding testamentary capacity.
