Tim Richards heads the Commercial Dispute Resolution Team. He is a commercial litigator with vast experience in handling a range of commercial disputes, including shareholder and contractual claims. He is recognised as a 'hugely accomplished litigator' (Chambers UK 2010) and is proactive in alternative dispute resolution. He is a CEDR and ADR Group trained mediator and regularly conducts mediation.
Tim also regularly advises on the generation, ownership, protection and exploitation of intellectual property including in particular brand protection and exploitation.
Recent work includes:
- Defending a multi million pound claim on an alleged latent design defect, involving substantial litigation in the Technology and Construction Court, and finally resolved at mediation
- Acting for the liquidators of a company against a High Street bank on a multi-million pound cheque conversion claim, which settled shortly before trial
- Bringing proceedings on behalf of a venture capitalist against the directors of a telecommunications company, where the claim involved allegations of misrepresentation and fraud by the directors and breach of a Shareholders Agreement
- Acting for one of the country's leading sports events organisers, prosecuting a trademark infringement action against a household name international sports company in the High Court
- Acting for the country's leading supplier of land and property environmental information in relation to a claim by a customer involving alleged negligent misrepresentation. The action was dismissed, which was a significant result because of the possibility of a flood of similar claims
- Advising a private company in relation to a substantial software claim
- Regularly advising a well known shoe designer on the registration of designs and the prosecution of trademark infringement claims
- Prosecuting claims to recover commercial debts large and small
- Successfully bringing High Court Judicial Review proceedings against the Agricultural Wages Board
